  • Concept Talk: MISA, Habeus Corpus Case & Article 21
In today's episode, we delve into one of the most crucial articles of the Indian Constitution—Article 21. This article has been the center of the famous debate between "Procedure Established by Law" and "Due Process of Law". We also explore Article 22, which pertains to arrests and Preventive Detention—issues that became highly significant during the Emergency of 1975. During the Emergency, thousands of individuals were subjected to preventive detention under the Maintenance of Internal Security Act (MISA), leading to their imprisonment for almost 19 months. The government made the MISA law extremely harsh and placed it in the Ninth Schedule, attempting to shield it from judicial review. This led to the famous "Habeas Corpus Case" or ADM Jabalpur v. Shivkant Shukla, which severely impacted the reputation of the Supreme Court at the time. Interestingly, the Supreme Court overturned this decision in 2017. Dr. Vikas Divyakirti breaks down these constitutional disputes in this detailed episode of Concept Talk. He aims to bring clarity to this significant chapter of India's constitutional history and encourage a deeper interest in constitutional studies. • Concept Talk: Baswan Committee Report
In this episode, Dr. Vikas Divyakirti takes a deep dive into the history of UPSC reforms and the various committees that have shaped its recruitment and selection processes over the years. From the 1976 Kothari Committee to the latest B.S. Baswan Committee in 2015, which evaluated significant issues like age limits, attempts, and the optional subject debate, Dr. Vikas explores the implications of these changes on aspirants, especially those from rural and Hindi medium backgrounds. He discusses how committee recommendations have impacted students from different regions, with a focus on the challenges faced by Hindi medium candidates in a system that has often favored English medium and mathematics-focused students. He also raises concerns about potential unintended consequences of proposed reforms, such as the reduction of attempts and the age limit, especially for students from rural areas who often graduate later and face longer delays in their academic journeys. Dr. Vikas sheds light on the socioeconomic disparities that persist in the education system, offering valuable insights into the need for a more inclusive and fair approach to UPSC reforms. Tune in to gain a nuanced understanding of how these changes could reshape the future of UPSC aspirants.
